The Upstairs/Downstairs Double Life of Josef Fritzl

Is there any story more terrifying than that of Josef Fritzl, the 73-year-old Austrian electrical engineer who imprisoned his daughter Elisabeth for 24 years in the family’s basement, fathered seven children with her, and murdered one of them? Fritzl lived a shadowy double life. Well respected in the sleepy community of Amstettten, Fritzl and his wife Rosemarie were, by all accounts, normal citizens raising their three grandchildren (ages 16, 14, and 12) abandoned periodically by Elisabeth, whom Fritzl claimed had joined a cult in 1984. But what friends and neighbors, and reportedly even Rosemarie herself and the three “upstairs children,” weren’t aware of was Fritzl’s downstairs life, where Elisabeth and three other children were kept with only an old television set and radio for contact with the outside world.

According to court reports, Fritzl drugged, handcuffed, and raped Elisabeth up to 3,000 times (sometimes on display of the children) during her imprisonment. When she resisted, he retaliated by harming the three children (now ages 19, 18, and 6) or by threatening to leave the four to perish in their 645-square-foot windowless, soundproof, electronically secured underground prison. Another child, a baby boy born in 1996, died days after birth due to Fritzl’s refusal to get medical assistance and was cremated in a domestic furnace. The captives endured lost teeth, damp and cold, malnourishment, physical decay, rats. Elisabeth suffered internal injuries from Fritzl’s sex toys and gave birth with only the most rudimentary trappings: a bucket for the blood, aspirin for the pain, a pair of rusty scissors to cut the umbilical cords. Only when the eldest daughter collapsed last April and Elisabeth was able to convince Fritzl to take her to the hospital were the children freed. Currently, the eldest daughter is in critical condition at a local hospital.

Many gaps still exist in the case and perhaps will never be explained, such as how Fritzl determined which children would be allowed to live upstairs, why social services didn’t uncover anything during their 21 visits to the family, to what degree Rosemarie may have been complicit in the imprisonment, and her tacit acceptance of the children. With Rosemarie, Fritzl fathered another seven children who appear to have had no involvement in the case, and it is unknown whether any of them had any knowledge of their sister’s disappearance.

During the trial, Fritzl covered his face with a blue binder, saying that he was “embarrassed” by the intense media coverage. Reports of Elisabeth’s attendance at the proceedings were never substantiated, but it is thought that her presence at the trial, as well as her 11 hours of videotaped testimony, was what finally shamed Fritzl into admitting his guilt in the depravity. Elisabeth is said to have emerged from the nightmare as a strong 42-year-old woman. In fact, it was her strength of character which may have drawn Fritzl to her in the first place. He desired to dominate his third daughter’s “obstinate” personality, much like his own, sensing that she was a greater challenge for him than Elisabeth’s siblings. Control was identified as a main theme in Fritzl’s life. The product of an over-domineering mother, Fritzl had been previously convicted of rape of another woman when Elisabeth was a toddler and had abused the girl well in advance of her imprisonment, which he said he sought as a way to protect her from the life of drinking and smoking that she pursued as she became a teenager.

Fritzl will spend the majority of his life sentence for rape, incest, murder, and enslavement at a psychiatric facility, where he could be eligible for release in as few as 15 years. Meanwhile, his broken family has been left with the arduous process of coming to terms with the ordeal. Elisabeth and the six children have been reunited and have been given new names and new lives in another town. They travel to regular sessions with psychotherapists. Rosemarie reportedly lives alone in a small apartment, where she is visited by the children, a concession that Elisabeth has made despite what must be a tense relationship with her mother. Published reports say that the initial union between the two sets of children and Elisabeth went better than expected, given the conditions of their meeting. But the “downstairs children” are developing at varying paces, struggling with stunted language, weak immune systems, and years without natural sunlight and vitamin D. The “upstairs children” have been forced to confront the lies scaffolding their existence and the existence of their new family members.

It’s easy, in hindsight, to point to the incongruities and attempt to lay blame on those who did not question Fritzl’s actions and intervene earlier. But perhaps the best course of action, now that Fritzl has been sentenced, is to give the family all the space, literally and figuratively, that it can tolerate until it mends. The healing process hopefully began the moment the four were freed last spring and accelerates with each day. Reports say that as the children emerged from the cellar last year, the youngest imprisoned child, the six-year-old boy, pointed to the sky and asked, “Is that God up there?”

Did Natavia Lowery kill Linda Stein or did she confess to a crime she didn’t commit?

On October 30th 2007 Linda Stein, a wealthy celebrity real estate broker, was murdered in her multimillion dollar Manhattan apartment. Her personal assistant Natavia Lowery was arrested and charged with beating Stein to death with a yoga bar. During a pretrial hearing on Thursday January 9th, a taped confession was played in the courtroom. Lowery admitted on tape to hitting Linda Stein about six times with a yoga stick. However, when first arrested and charged Lowery pleaded not guilty.

Lowery’s original lawyer Ron Kuby had previously suggested that Lowery was coerced into confessing to a crime she did not commit. Lowery’s parents were also convinced that their daughter was innocent and police had used psychological abuse tactics to get her to confess to the crime.

Is it possible for police to force people to confess to something they did not do?

Psychologist say people can be made to confess to committing a crime they did not commit. This list of tactics often used by police shows some of the ways in which an innocent person might cave into pressure and confess to a crime they did not commit. The list is excerpted from an article found on the Cengage Learning website titled “Why Do People Confess to Crimes They Did Not Commit?
Law Enforcement Tactics that Can Lead to False Confessions

    1. lengthy interrogations (in this case 14 to 30 hours)
    2. denying subjects food, water, and bathroom breaks
    3. putting suspects in a small room under bright lights
    4. offering the suspect several theories of why he might have committed the crime and acting sympathetic to the defendant
    5. suggesting that the person will have an easier time if he talks
    6. telling a subject that he has failed a lie detector test (even if he did not)
    7. telling a subject that others charged have already confessed and/or implicated the subject (even if they have not)
    8. telling subjects they will be charged with a more serious offense if they don’t confess

      It does not appear police have anything other than Natavia Lowery’s confession to prove she committed the crime she has been accused of committing. They found no blood on Lowery’s clothing even though Linda Stein’s blood had been splattered all over her apartment according to some reports; and they did not find the yoga bar that Lowery claims she used to kill Linda Stein.

      Lowery claimed in the confession that she killed the 62 year old woman because the woman was always yelling at her and because, on the day of the murder, the woman was blowing marijuana smoke in her face and making racist remarks. However, Lowery’s family claimed there was no bad blood between Natavia Lowery and Linda Stein. They say Lowery is a sweet girl who wouldn’t hurt a fly; but Lowery had been in trouble with the law before her arrest for Linda Stein’s murder. She had apparently stolen someone’s identity and used the stolen identity to obtain two credit cards. Charges had been dropped in that case; but it is unclear if the charges were dropped because Lowery was deemed innocent or for other reasons.

      Natavia Lowery’s family probably believe in their hearts that she is innocent. The picture they paint of the girl is probably an accurate portrayal of the girl they knew; however, the picture that police have painted of the woman who murdered Linda Stein could be an accurate portrayal of a side of Natavia that her family knew nothing about. It is easier for her family to believe Natavia admitted to a crime she didn’t commit because of the pressure placed on her by police. They say she was threatened, told her mother would be filing a missing person’s report if she didn’t confess, refused her requests to have an attorney present and questioned her for hours, subjecting her to various forms of tactical interrogation with a goal to make a suspect confess one way or another.

      The fact that Lowery’s original lawyer Ron Kuby is no longer representing her after being insistent that she was innocent and that she was forced to confess, seems to reduce the forced confession angle to wishful thinking.

      Man stabs bus driver to death in Brooklyn

      46-year old Edwin Thomas, a Brooklyn New York bus driver, was stabbed to death after refusing to give a passenger a transfer slip. Edwin Thomas was attacked by a passenger on bus B-46 in Brooklyn after he denied the passenger’s request for a transfer. The passenger had swiped an invalid fare card and taken a seat on the bus despite not paying for the ride. When Edwin Thomas told him he could not get a transfer slip since he didn’t pay the bus fare, the man punched him in the head then stabbed him.

      Edwin Thomas was rushed to the hospital and pronounced dead on arrival. His attacker fled the scene of the incident. There is a $12,000 reward for information being offered by police as well as the MTA and TWU Local 100.

      In a statement New York governor, David Paterson, said he was shocked and saddened by the killing, calling Edwin Thomas a man who “spent his career ensuring the safety of his passengers”; and New York Mayor Michael Bloomberg called Thomas a good man who was “good at his job of helping move New York City”.

      The mayor said he spoke with Thomas’s son Jeffrey, offering the family his sympathies.

      Woman tires of demands for sex, kills ex-husband

      Earl Brown of Kansas City Missouri has been shot dead by his ex-wife, 50-year old Sharon Brown. Sharon Brown has told police that she shot her ex-husband because she got tired of him coming over to her house and demanding sex.

      The shooting took place around 11PM last Monday, November 24, at 9601 East Bannister Road. Based on information provided to police by Sharon Brown, Earl Brown showed up at her house demanding sex. She refused him and insisted he leave the premises. When he in turn refused to leave and take no for an answer, she retrieved a gun from a nightstand in the home and shot Mr. Borwn. She then called her sister who came over, and the two called the police.

      Police arrived at the residence to find Earl Brown lying dead on a bed. He was nude and wearing a handcuff on his wrist.

      Sharon Brown is being charged with second degree murder.

      Kenneth Hissom kills wife Carla Hissom on Thanksgiving

      A Huntsville, Arkansas man called 911 on Thanksgiving to report shooting his wife. Kenneth Hissom called police and informed them he had shot his wife Carla Hissom in the face. Police arrived at 845 Edgewood Place, Lot 1 at 6:47 p.m. Hissom refused to come out of the mobile home without his gun. It took almost 2 hours before police managed to convince him to give himself up.

      When police were finally able to enter the home, they found Carla Hissom on the floor unconscious and unresponsive. Carla Hissom was taken to the hospital where she was pronounced dead at 4AM.

      Hunstville police say they have had calls from the Hissom household in the past in relation to domestic abuse. According to reports, Kenneth Hissom has told police he shot is wife because she had been “nagging him all day”.

      Hissom has not yet been formally charged yet. He is currently sitting in the Madison County Jail awaiting a bond hearing.

      Cheryl Busch shoots her 18-month old daughter dead with a .357 magnum

      According to published reports a Hollister, California mother was taken into custody last week after her  18-month old daughter was found dead. The child had been shot.

      There are conflicting reports as to how the police were alerted of the crime. Some reports state that Cheryl Busch called 911 and told the dispatcher that she had killed her daughter. Other reports state that Cherly’s husband John called the police after he discovered his wife had shot their daughter. John Busch had apparently gone outdoors after an argument with his wife. While outside he heard gunshots. After rushing back inside he discovered that his wife had shot little Donna Busch in the chest and head.

      San Benito County Sheriff, Curtis Hill said of the crime:

      “Our victim, Donna Busch, was killed with a Smith and Wesson 357 magnum revolver.”

      “In my 32 years, I don’t remember a mother killing a child.”

      Reshma James murder also claims life of Dennis John Malloosseril

      Dennis John Malloosseril, a director of the St. Thomas Syrian Orthodox Knanaya Church tried to prevent the murder of  Reshma James by her estranged husband Joseph Pallipurath.

      Pallipurath showed up at the church in Clifton New Jersey just after noon on Sunday and opened fire, killing his wife and shooting 23-year old Dennis John Malloosseril and 47-year old Silvy Perincheril in the head when both tried in vain to save Reshma James.

      Malloosseril and Perincheril were both rushed to St. Joseph’s Regional Medical Center in Paterson, New Jersey in critical condition.

      As of today, the Passaic County Prosecutor’s Office has confirmed that Dennis John Malloosseril died late last night as a result of his wounds.

      Man fatally shoots estranged wife at NJ church

      24-year-old Reshma James was gunned down by her estranged husband, 27-year-old Joseph M. Pallipurath in the vestibule at St. Thomas Syrian Orthodox Knanaya Church in Clifton New Jersey.

      Joseph M. Pallipurath is reported to have driven all the way across the country from San Francisco to New Jersey to confront Reshma James who had apparently only recently moved to New Jersey to escape spousal abuse at the hands of Pallipurath.

      Just after noon on Sunday November 23rd, Pallipurath shot and killed James as members of St Thomas Syrian Orthodox Knanaya Church were filing at the end of service.

      A 47-year-old woman and 23-year-old man were also reportedly shot in the head during the attack. Both are listed in critical condition at St. Joseph’s Regional Medical Center in Paterson.

      Shooting at a mall in Tukwila, Washington

      One man has been killed and another has been left critically injured after a shooting at a Tukwila, Washington shopping center Saturday night.

      Based on statements from eye-witnesses it appears there was a fight between a group of young people and one pulled out a gun during the fight and proceeded to open fire.

      The mall then became a scene of frenzy with parents grabbing their children and running, store employees running to the backs of their establishments and barricading themselves and other people in staircases who heard the gun shots turning and running.

      The gunman is still at large. His victims are reported to be in their twenties. No information has yet been released as to the victims’ names.

      Prosecutors ask to drop charge against 8-year old Arizona boy

      New developments in the case of the 8-year old Arizona boy accused of killing his father Vincent Romero, and his father’s house-guest Tim Romans. On Friday, an Arizona prosecutor filed a motion in juvenile court to have the boy cleared of charges of killing his father, stating in the motion that “the interest of justice will be served by such a dismissal.”

      There is currently only speculation as to what might have lead to the prosecutors filing the motion of dismissal after previously trying to push to have the 8-year old tried as an adult on double-murder charges.

      Earlier this week video was released of the interrogation that was conducted by Arizona police, and it was brought to light that the boy had initially claimed he found the victims dead when he arrived home. The conflicting accounts of what took place at Romero household on the day Vincent Romero and Tim Romans were murdered, in addition to the situation of investigators questioning the boy without an adult present could have presented insurmountable complications for the prosecution. It is also possible that the police have found new evidence in the case, but so far there has been no release of information from anyone involved in the case to shed light on why the prosecution is moving to drop the charges against the boy for killing his father.
